Terms for the live site and waitlist.

These Terms of Service govern your access to and use of chiru.nl, any waitlist forms or related launch communications made available through the site, and any other services on the site that expressly link to these Terms.

By using the site or submitting your email address to the waitlist, you agree to these Terms and to the Chiru Privacy Policy. If you do not agree, do not use the site or join the waitlist.

As of the effective date below, these Terms cover the public website and waitlist experience. If Chiru later launches an app, account system, beta product, or paid features, additional or updated terms may apply to those services.

You must be at least 16 years old and able to form a binding agreement under applicable law to use the site or join the waitlist. If you use the site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

• Joining the waitlist does not guarantee that you will receive an invite, receive one within any specific time frame, or receive access at all.
• We may prioritize, delay, limit, or stop invite waves at our discretion.
• If we invite you to a beta experience later, that experience may be incomplete, unstable, or subject to separate rules, eligibility requirements, or third-party platform terms, including Apple TestFlight terms where relevant.
• You may unsubscribe from non-essential waitlist or launch emails at any time.

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the site for your personal, lawful use in accordance with these Terms.

• Using the site in violation of any law, regulation, or third-party right.
• Attempting to disrupt, damage, probe, overload, or gain unauthorized access to the site, its infrastructure, or related systems.
• Scraping, copying, framing, mirroring, or using automated means to access the site except as permitted by standard search engine indexing or our written consent.
• Impersonating another person or submitting false, misleading, or unauthorized information through the site or waitlist.
• Uploading or transmitting malware, malicious code, spam, or other harmful material.
• Using the Chiru name, branding, content, or materials except as expressly permitted by these Terms or by prior written permission.

The site, its design, text, graphics, logos, trademarks, content, and underlying technology are owned by or licensed to Chiru and are protected by intellectual property and other laws.

Except for the limited right to use the site under these Terms, no rights are granted to you by implication, estoppel, or otherwise.

If you send us ideas, comments, suggestions, bug reports, or other feedback, you grant Chiru a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, copy, modify, publish, and otherwise exploit that feedback for any purpose without compensation or attribution to you.

The site may reference or link to third-party services, and future beta access may be delivered through third-party platforms. Those third parties operate under their own terms and privacy practices, and Chiru is not responsible for them.

The site and waitlist are provided on an as-is and as-available basis to the maximum extent permitted by law. We may modify, suspend, or discontinue all or part of the site at any time without notice.

To the maximum extent permitted by law, Chiru disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, error-free, or suitable for your needs.

To the maximum extent permitted by law, Chiru and its founders, team members, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the site, the waitlist, or these Terms.

To the maximum extent permitted by law, the total aggregate liability of Chiru for any claim arising out of or relating to the site, the waitlist, or these Terms will not exceed the greater of EUR 100 or the amount you paid us, if any, for the relevant service during the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and if you are a consumer, you retain any mandatory rights that apply under the law of your country of residence.

You may stop using the site at any time. We may suspend or terminate your access to the site or remove you from the waitlist if we reasonably believe you violated these Terms, created risk for the service or others, or where suspension is necessary for legal, security, or operational reasons.

Sections that by their nature should survive termination, including sections on intellectual property, feedback, disclaimers, limitation of liability, governing law, and dispute resolution, will survive.

These Terms are governed by the laws of the Netherlands, excluding its conflict of laws rules.

If you are not a consumer, the courts of Amsterdam, the Netherlands will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the site.

If you are a consumer, you may have the right to bring a claim in the courts of your country of residence and to rely on mandatory consumer protections that apply to you.

We may update these Terms from time to time. When we do, we will post the revised version here and update the effective date below. By continuing to use the site after the updated Terms become effective, you agree to the revised Terms.
